The Website is designed to provide information and products about coaching and to create a connection for like-minded people interested in the classes, the community, and the topics we discuss and archive. The Website is owned by Dalia Lane Creations LLC (“DLC”). PLEASE READ VERY CAREFULLY THE FOLLOWING TERMS AND CONDITIONS FOR USE OF THE WEBSITE.
1. Acceptance of Terms. This Terms and Conditions of Use Agreement (this “Agreement”) sets forth legally binding terms for your use of the Website. By using our Website, you agree to be bound by this Agreement, whether you are a “Visitor” (which means that you simply browse our Website) or you are a “Member” (which means that you have registered on our Website as a user); Visitors and Members are referred to in this Agreement as “Users”. If you do not accept the terms of this Agreement, you should leave our Website and discontinue use of the Services immediately. We may modify this Agreement from time to time, and such modification shall be effective upon its posting on our Website. 2. Waiver and Release. This site offers information relating to the practice and philosophy of yoga and is designed for educational purposes only. Not all exercises are suitable for everyone and this or any other exercise program may result in injury. To reduce the risk of injury in your case, consult your doctor before beginning any exercise program. The instructions and advice presented are in no way intended as a substitute for medical counseling. You should not rely on this information as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment. If you have any concerns or questions about your health, you should always consult with a physician or other health-care professional. Do not disregard, avoid or delay obtaining medical or health related advice from your health-care professional because of something you may have read on this site. The use of any information provided on this site is solely at your own risk. The Material on this Site may not be tailored to match your energy, health or fitness level. If you are concerned about whether any exercises identified on this Site or in any of the Material are right for you, do NOT do them unless and until you have cleared it with your physician. The Material available on this Site involves rigorous exercise. Make sure you exercise in a large well-lit area that is free from obstacles and that you wear comfortable clothing that doesn’t inhibit movement. Stop exercising and consult your physician if you feel dizzy, faint, light-headed or if you experience any discomfort. Only you can monitor your condition during your yoga class. You are responsible for exercising within your limits and seeking attention and advice as appropriate. Never force or strain. You should prepare physically, mentally and spiritually before any yoga class and relax in Shavasana afterwards. Avoid alcohol and or heavy meals for 2 hours before yoga class. Drink fluids (preferably water) before and after yoga class.
3. APEXLIFEMETHOD.COM disclaims any liabilities or loss in connection with the exercises and teaching advice herein. Participate at your own risk.
4. Security Components. You understand that our Website and software embodied within our Website include security components that permit digital materials to be protected, and that use of these materials is subject to usage rules set by APEXLIFEMETHOD.COM and/or content providers who provide content to APEXLIFEMETHOD.COM. You may not attempt to override or circumvent any such security components and usage rules embedded into our Website.

13. Disclaimer of Warranties. You expressly understand and agree that:

We may also require you to follow additional rules, guidelines or other conditions (“Additional Terms”) in order to participate as Certified APEXLIFEMETHOD.COM Teacher, or activities available through our Website, to obtain certain premium Content through our Website, or for other reasons. In addition, certain Additional Terms will govern any purchases you make through the online store located on our Website. These Additional Terms will be posted on the relevant portions of our Website or on the portions of our Website that describe the specific certification, Content, or activities. These Additional Terms are part of this Agreement, and you agree to comply with them when you participate in those certification programs, purchase items from our online store, or otherwise engage in activities governed by such Additional Terms.
16. Entire Agreement. This Agreement, together with any other terms or policies referenced herein (including without limitation the Privacy Policy and Additional Terms), constitutes the entire agreement between you and APEXLIFEMETHOD.COM and governs your use of the Website and Services, superseding any prior agreements between you and APEXLIFEMETHOD.COM with respect to the Website and Services; including Certification and Registration of Teachers and Yoga Centers.
17. Choice of Law and Forum. This Agreement and the relationship between you and APEXLIFEMETHOD.COM shall be governed by the laws of Switzerland without regard to its conflict of law provisions. You and APEXLIFEMETHOD.COM agree to submit to the personal and exclusive jurisdiction of the courts located within the country of Switzerland.
18. Waiver and Severability of Terms. The failure of APEXLIFEMETHOD.COM to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.
19. Statute of Limitations. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website, the Services or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.
